Over 600 total interventions from individuals, associations and condominiums have been filed on behalf of more than 4,500 of owners, who are taking steps to actively protect their property rights against Walton County’s lawsuit.  Many owners have retained an attorney to protect their rights.

During a court hearing on February 18, 2019, the judge granted motions to intervene for all but a handful of interventions and no interventions were denied.  The court also ruled that the county had 60 days to serve notice on any property owners who have not yet received notice or have not intervened.  On February 22, 2019 the county mailed second notices to 1,280 interested parties, including over 260 parcel owners.

On January 11, 2019, Walton County mailed notices to all beachfront property owners of its action to seek declaratory judgment affirming the existence of recreational customary use on all privately owned beachfront parcels in Walton County.  This followed their court action, which was filed on December 11, 2018,

If left unchallenged, this means that the sandy beach portion of your property would be subject to public use and you would have no rights of exclusion.  That means your right to enjoy your private property is now under attack in court by your Walton Commissioners.

To protect your property rights, you must actively intervene.  You cannot rely upon your neighbor to protect your rights.  Act quickly to defend your rights, or you could lose some of your property rights forever.

Important Update:

If you are just receiving your notice, you must act promptly to protect your property rights. The court has set June 20, 2019 as the deadline to intervene.  If you received your notice several weeks ago, and your 45 day window to file has expired, you may be able to challenge that deadline.  Please contact legal advice today!

Walton Commissioners, as the plaintiff in this lawsuit, have the burden of proof to demonstrate that the public’s use of your private beachfront property has been ancient, reasonable, without interruption, and free from dispute.
